Newsflash ' June 2007

Employment, Social Security and Immigration Law

As of June 1, 2007 additional documents need to be joined to the application for a visa on the basis of family reunification with a non-EU national

Until now, the hereafter mentioned documents had to be joined to the application for a visa on the basis of family reunification:

- The valid passport;

- A birth- and marriage certificate, duly translated and legalized;

- A duly legalized and translated certificate of good conduct covering the last five years

- A copy of the Belgian residence permit (BIVR/CIRE) of the spouse in Belgium;

- 2 duly completed application forms;

- 2 recent passport-sized photographs;

As of 1 June 2007, the following documents should also be joined to the application for a visa on the basis of family reunification, in addition to the abovementioned documents:

A medical certificate. The attestation has to be completed by a doctor recognized by the Belgian consular authorities of the applicant's place of residence abroad.

Proof of affiliation with a sickness fund, being an attestation confirming that the family members can affiliate themselves with this sickness fund upon their arrival in Belgium or a proof that the family members are covered for health and sickness costs by a private insurance fund.

An attestation issued by the local Belgian police authorities confirming that the family member actually lives on the given address in Belgium;

Please note that for foreign nationals coming over to Belgium in the framework of family reunification with a non-EU national (e.g. US or Japanese nationals) and who do not require a visa to register with the local Belgian communal authorities, the additional documents will also be required in order to obtain the Belgian residence card.

Dear Experts

My Florida license has expired in America. because I am in a rush to join my Belgian wife I may not have time to renew my Florida drivers license. will this cause a lot of problems in obtaining my Belgian license. also, is the test in English. My Dutch is very poor............thanks

Bill Hancock

Dear Bill,

We suggest that you renew your license before you come over to Belgium. If your driver's license has expired, then it will not be accepted in exchange for a Belgian driver's license. In practice, this would mean that you will have to follow a theoretical course and will have to take an examination in order to obtain a Belgian driver's license. The examination is in Dutch.

Best regards, Katrien Matthias
